This paper adjusted the positions of the theory on the nature of a stipulation, classified them according to the characteristics of the exemption stipulation, examined all the interpretation principles applied to the interpretation of stipulation and the control principle to the exemption principle in researching on the interpretation of the exemption stipulation of car insurance.

  In exploring the exemption stipulation of car insurance, it examined the effect of theories as to the rough meanings and contradictions of the exemption stipulations of non-license, drunken drive and industrial accident which have become an issue most in interpretation and practical work, and focused on exploring what direction the interpretation of the same exemption stipulation has been embodies by a case law.

  Looking at the individual exemption stipulation, for the exemption stipulation for non-license, the paper considered the theoretical contradictions to the effect, revision of it according to the changes of a case law, the interpretation of a case law to one standard in applying the exemption clause of non-license, express and implicit approval.

  For the exemption stipulation of drunken drive, it considered the theoretical contradictions to the legislative examples and effects, the current trend of a case law and the background of the requests for the violation of the constitution and constitutional petition being presented.

  For the exemption stipulation of industrial accident, it examined the theoretical contradictions to the legislative examples and effects, and the respect that only this stipulation of the exemption stipulations of car insurance provides the individual application principle of the insured, reviewed the judgement standards of business disasters and meaning of 5 persons at all times which are at issue in applying the stipulation through a case law.

  After reviewing all the exemption stipulations, it grasped the problems like moral risks which can occur in applying the application of the exemption stipulation at the practical handling of the insurance and their solution plans.
